College student dies in fall from Strip hotel after EDC and taking Ecstasy

From a legal perspective, I am not sure how her parents could sue anyone (and actually win). What did EDC or the hotel do wrong? They didn't give her the drugs. She took the drugs and jumped out the window. How is that anyone else's fault? I know that sounds harsh, but give me a break. Why is everyone's first reaction that people are going to get sued? People need to take responsibility for their own actions and stop pointing the finger at someone else.

Sad story. This a good wake up call people. I know we all like to go to Vegas and rage and party all crazy but sometimes getting too nuts is not worth it.

Theyll probably sue everyone. Insomniac because she was partying there and they didn't go above and beyond to prevent this from happening. Keep in mind they settled when the las person passed away in la. MGM because they own circus circus and she was able to get through the window bars and jump.

Insomniac has zero legal liability...the death happened 15 miles away from their event.

The hotel has minimal liability as well. If hotels were liable for this type of behavior, then every Vegas hotel would have bars on the windows, just like a prison cell.

However, I can 100% see how some flea bag lawyer has already contacted the deceased girl's family and planted the seed.
I'll bet there have been a BUNCH of lawyers in constant contact with them...all from different firms.
They'll sue everybody with hopes that just one of them settles out of court.

of course insomniac will be sued, provided the girls family wants to bring suit, same as mgm, the private security firm, the individual security, the cab company, etc. it's a plaintiff's attorney's nature to throw everything at the wall to see what sticks. trust me. i unfortunately am one. the goal will be to settle out of court in hopes that none of these entities will want their names tied to this death and claim even more so than they already are. one by one, however, each individual defendant will move to get out of the suit and will most likely do so based on whatever lack of liability and culpability they possess. it'll be as much media-driven as it will be legal-driven.

I think this past new years day someone fell off the Cosmo terrace and another one abt a year ago. Theres been stabbings along the strip and I think a recent one was in front of PH. I remember there was some fight at Crown that escalated to the streets and fwy with gunfire between 2 cars. I've heard from others about muggings on certain parts of the strip(near harrahs and MGM). And remember tupac was shot on corner of Harmon and LV blvd.

I'm sure bunch of stuff happens. they actually show up on the vegas tv news at times. most of us just dont hear about it. Its like any other town... it experiences its own share of bad seeds and stupid crap that involves death.

I feel like if you fell off the cosmo terrace you had to climb over something because they put in those bumper rails just so you can't lean over the edge like that

I'd be surprised if a jury found the hotel's negligence (whatever that negligent act might be alleged to be) was greater than the deceased woman's negligence (Nevada law bars a plaintiff's claim if the plaintiff's negligence exceeds the combined negligence of all defendants).

I agree. Anyone can sue anyone for any reason, but I don't see the hotel being held negligent here. From the article is sounds like the girl did took extraordinary effort to access the window despite appropriate safe guards against routine access. Granted she was in an inappropriate state of mind, but a business/hotel can't be expected to take routine precaution against this. Terrible situation none the less.

At least you are honest about the typical mindset for a Plaintiff's attorney (I am a civil defense attorney). If I was representing any of the potential defendants in this case, I would certainly advise them NOT to settle. This case won't get past summary judgment.

agreed. i'm sure it's the potential defendant's hopes that the media doesn't take the story to the next level like they do with so many cases. i'm in NY, so I have no idea what the press has been like, but that's the worst thing that could happen to these potential defendants, because that's when the plaintiff attorney sharks will come out and smell blood in the water.

and trust me, lol, it's not by choice that i'm a plaintiff's attorney! or litigation at all for that matter!

There's 100,000 people at EDC per night. There's a chance that could have happened to 1 person. Its not like that all over. There were a total of about 60 arrests that whole weekend. Thats a very small percentage for a large event that size.

EDC specifically set up special "task force" called GROUND CONTROL that was supposed to do this job, it was formed after the incident in LA, and they were supposed to be roaming around EDC all weekend looking for people who needed to help and explain to them that getting in trouble with the police is alot better then trying to just figure it out

Call me harsh, but one or two people out of tens of thousands dying is not that big of deal. A hundred people probably die every week in Vegas from heat exhaustion, stroke, heart attack, alcohol poisoning, car wrecks, bad drugs, cancer...

Its either you're wording it wrong or you're just plain insensitive. 1 person dying anywhere IS a big deal. Doesnt matter if it was heat exhaustion, violence, accident or drugs. It still means something. It could have been prevented and it didnt have to happen.

If you tripped, fell on your face, broke your nose and caused a blood clot to travel into your brain and heart, then caused you to die. Do we say to your family, hey at least it was the only death in the venue. Hows that for great statistics.
